Privacy
These Terms of Use (“Scribe Terms”) apply to your use of Medscape’s Scribe, which is a transcription tool on Medscape, a platform designed for healthcare professionals to document and summarize patient interactions into a clinical note template for transfer to EHR systems. These Scribe Terms supplement the Medscape Network Terms of Use, which are incorporated herein, and Scribe shall be deemed “Services” thereunder.
By using Scribe, you agree to our Business Associate Agreement available [here] that governs your transfer of protected health information to Medscape. For clarity, Medscape is not a custodian of record, and any recordings, transcriptions or summaries are not to be deemed a patient record.
Medscape is committed to protecting the privacy and security of the data collected by and transmitted through Scribe by implementing security measures to prevent unauthorized access and to comply with applicable laws. You are responsible for ensuring that your systems and devices and your use of Scribe comply with HIPAA and other applicable laws.
Your Use of Scribe
You are solely responsible for obtaining all necessary consents and providing all required notices for your use of Scribe, including for recording any patient interactions and for sharing health information with Medscape for the purposes described herein. By using Scribe, you represent to Medscape that you have obtained any and all such consents and provided any and all such notices prior to use, in each instance.
You are solely responsible for transferring summaries to your EHR system within seventy-two (72) hours of creation. Scribe will automatically delete all data after this period, and Medscape cannot be held responsible for the loss of any information that you do not properly and timely transfer to your EHR.
You are solely responsible for verifying the accuracy of all transcriptions and summaries generated by Scribe. You should not rely on Scribe for critical decision-making, and you should review all summaries and make any necessary changes before transferring to your EHR. Scribe transcriptions and summaries are not intended to be a substitute for professional medical advice, diagnosis or treatment.
You understand and acknowledge that Scribe utilizes certain generative artificial intelligence technologies provided by third-party licensors, and Medscape cannot be held responsible for the reliability or dependability of any such technologies.
Changes to Scribe Terms
We reserve the right, at our sole discretion, to modify, discontinue or terminate Scribe or these Scribe Terms, at any time and without prior notice. By continuing to use Scribe after we have modified these Scribe Terms, you agree to be bound by the modified Scribe Terms. If the modified Scribe Terms are not acceptable to you, you agree to immediately stop using Scribe.
